Real Estate Employee Offboarding Standard Operating Procedure Template
Free employee offboarding SOP for real estate brokerages. Covers license transfer, client reassignment, and system access revocation.
Purpose
Handle departing agents and staff so that active transactions are reassigned, client relationships are protected, system access is revoked, and the agent's license is properly released from the brokerage. An agent departure with open transactions creates immediate risk for clients and the brokerage.
Scope
Covers voluntary departures, terminations, and retirements for agents and administrative staff. Does not cover team splits within the brokerage or inter-office transfers.
Prerequisites
- Departure date confirmed
- List of all active transactions and pending listings pulled from Dotloop
- Replacement agent identified for active transactions
- IC agreement reviewed for any non-compete or non-solicitation provisions
Roles & Responsibilities
Managing Broker
- Reassign all active transactions and listings to replacement agents
- Notify clients of the agent change and introduce the replacement
- Release the departing agent's license with the state commission
Office Manager
- Revoke MLS, Dotloop, and brokerage email access on the departure date
- Collect lockbox keys, yard signs, and brokerage materials
- Remove the agent from the brokerage website and directory
Transaction Coordinator
- Verify all active transaction files in Dotloop are complete and current
- Brief the replacement agent on pending deadlines and contingencies
- Update all transaction parties (title, lender, cooperating agent) on the agent change
Procedure
Confirm the agent's last day and reason for departure. Review the independent contractor agreement for non-compete, non-solicitation, and commission provisions. Determine which pending commissions the departing agent is entitled to based on the agreement terms.

Why This Matters for Real Estate
Real estate agent departures happen frequently — agents switch brokerages, leave the industry, or retire. Each departure puts active client relationships and open transactions at risk. A client whose agent disappears without introduction to a replacement feels abandoned and may file complaints with the real estate commission. An open transaction with no assigned agent and an approaching closing date can fall apart, costing everyone involved. The brokerage's reputation depends on making the transition smooth for clients.
Common Mistakes
- ×Letting the departing agent handle client notifications themselves, which often becomes a solicitation to follow them to the new brokerage
- ×Not revoking MLS access promptly, allowing the departing agent to continue accessing listing data under the former brokerage's credentials
- ×Forgetting to remove the agent's name from active yard signs and online listings, confusing clients and potential buyers
- ×Delaying the license release filing, which prevents the agent from associating with their new brokerage and may create regulatory issues
- ×Not clarifying commission splits for pending transactions before the departure, leading to disputes after closing
Real Estate-Specific Notes
The independent contractor model in real estate means agents aren't employees — they can leave quickly, often with just days of notice. The IC agreement governs post-departure obligations: non-solicitation periods (if enforceable in the state), pending commission rights, and file transfer procedures. Some states require the broker to release the license within a specific number of days after departure. Client files belong to the brokerage, not the departing agent — the agent cannot take original transaction files, though clients can request their own copies. Active listings may need new listing agreements with the replacement agent if the original listing agreement was personal to the departing agent.
